With the creation of microbusiness, cooperative, and delivery license types, New York’s Cannabis Regulators are trying to encourage small businesses and farmers to participate in the cannabis industry. As such, cannabis is now legal in New York for adults 21 years of age and older and can be consumed in a private home, anywhere tobacco use is allowed and at soon-to-be-permitted, state-licensed consumption lounges. These lounges will be similar to those already operating in California and other states, where cannabis — but not alcohol — can be consumed onsite, once regulations are in place.

New York’s Cannabis Control Board (CCB) has already approved licenses to cultivate recreational cannabis, issuing 52 permits to local hemp farmers that have grown and harvested hemp (cannabis plants with a THC below 0.3%) for at least two of the past four years, based on the Conditional Cannabis Cultivation Bill Governor Kathy Hochul signed into law in February 2022.
The Conditional Cannabis Cultivation bill also authorizes the state to grant temporary licenses to adult-use cannabis processors.
